Consent to the Processing of Health Data and Release from Medical Confidentiality

1. Introduction

In connection with the use of the services provided under the brand AskGermanDoc, personal data – including special categories of personal data (health data) – are processed.

The processing of health data requires your explicit consent pursuant to:

  • Article 6(1)(a) GDPR

  • Article 9(2)(a) GDPR

Without your consent, AskGermanDoc cannot provide its services.

Your consent is voluntary.


2. Controller

The controller within the meaning of the General Data Protection Regulation (GDPR) is:

3. Categories of Data Processed

By giving my consent, I agree to the processing of the following categories of data:


a) Identification and Contact Data

  • Full name

  • Date of birth

  • Address

  • Email address

  • Telephone number

b) Health Data (Special Categories of Personal Data)

  • Medical history and diagnoses

  • Physician letters and reports

  • Imaging results (MRI, CT, X-ray, etc.)

  • Laboratory findings

  • Medication details

  • Medical questionnaires

  • Consultation notes

  • Any medical documents uploaded by me

c) Payment Data

  • Billing details

  • Transaction data processed via Stripe

  • Invoices and confirmations


4. Purpose of Processing

My personal and health data may be processed for the following purposes:

  • Assessment and evaluation of my medical case

  • Organization and coordination of medical second opinions

  • Forwarding medical documentation to cooperating licensed physicians

  • Conducting telemedical consultations

  • Preparation and delivery of written medical second opinions

  • Translation of medical documentation by professional translators

  • Quality assurance

  • Documentation and legal compliance

  • IT security and system integrity

  • Contract performance and billing

  • Defense against legal claims

Processing is limited strictly to what is necessary for these purposes.


5. Disclosure to Third Parties

I understand and agree that my health data may be shared, strictly for the purposes described above, with:


a) Cooperating Licensed Physicians

For the purpose of preparing medical second opinions or conducting telemedical consultations.


b) Professional Medical Translators

Where necessary to translate medical documentation.


c) IT and Hosting Providers

Including infrastructure providers located within the European Union, such as:

  • DigitalOcean (EU infrastructure)

  • Amazon Web Services (AWS, EU infrastructure)

d) Payment Service Provider

Stripe Payments Europe Ltd. for payment processing.



6. International Patients


All health data are stored on servers located within the European Union.

If I reside outside the European Union, I understand that medical reports and consultation results will be transmitted electronically to me in my country of residence. This transmission may involve data transfer to a country outside the EU.



7. Storage Duration

Health data and medical documentation are stored for a period of 10 years, unless longer retention is required by applicable law.

Data not subject to statutory retention obligations will be deleted once they are no longer necessary for the stated purposes.



8. Release from Medical Confidentiality (§ 203 German Criminal Code – StGB)

For the purpose of providing the AskGermanDoc services, I hereby expressly release from their statutory duty of confidentiality pursuant to § 203 German Criminal Code (Strafgesetzbuch – StGB):

  • DIT Deutsches Institut für Telemedizin UG (haftungsbeschränkt),

  • its managing director and authorized employees,

  • commissioned cooperating physicians,

  • contracted medical experts,

  • professional medical translators,

  • and contracted IT and hosting service providers to the extent technical access to health data is required,

insofar as this is necessary for:

  • evaluation of my medical documentation,

  • preparation of medical second opinions,

  • execution of telemedical consultations,

  • translation of medical records,

  • secure storage and transmission of medical data,

  • documentation and legal compliance.

This release applies exclusively to the purposes described in this declaration and only to the extent necessary for service provision.

It does not permit disclosure beyond the purposes stated herein.

I understand that without this release from confidentiality, AskGermanDoc cannot provide its services.



9. Voluntary Consent and Right of Withdrawal


My consent to the processing of personal and health data, as well as the release from medical confidentiality, is voluntary.

I may withdraw this consent at any time with effect for the future without providing reasons by sending an email to:

info@askgermandoc.com


Withdrawal does not affect the lawfulness of processing carried out prior to withdrawal.

If I withdraw my consent, AskGermanDoc will no longer be able to continue providing medical services. Processing of my health data will cease unless statutory retention obligations require continued storage.


Where legally permissible, data will be deleted without undue delay after withdrawal.



10. Data Subject Rights


I have the right to:

  • Access my personal data (Art. 15 GDPR)

  • Rectify inaccurate data (Art. 16 GDPR)

  • Request erasure (deletion) of my personal data (Art. 17 GDPR)

  • Restrict processing (Art. 18 GDPR)

  • Data portability (Art. 20 GDPR)

  • Lodge a complaint with a supervisory authority
